What is IRS Form 6166?

Form 6166 is the IRS-issued U.S. residency certification letter. It is not a blank form that the taxpayer fills out. The taxpayer requests Form 6166 by filing Form 8802, and the IRS issues Form 6166 if the request is approved.

What is IRS Form 8802?

Is Form 8802 the same as Form 6166?

No. Form 8802 is the application. Form 6166 is the certificate issued after the IRS approves the application. Taxpayers do not complete Form 6166 directly.

This distinction is important because paying the IRS user fee or preparing Form 8802 does not automatically create Form 6166. The IRS must review and approve the Form 8802 request first.

What types of applications and applicants are supported?

Form8802.com currently supports guided application generation for U.S. citizen individual applicants and certain U.S.-owned or U.S.-originating entities, including partnerships, trusts, estates, S corporations, QSubs, and disregarded entities.

Applications from non-U.S. citizens, foreign-owned entities, or foreign-originating entities are not currently supported. Multiple-year procedures are not currently implemented.

Supported requests may indicate the purpose as claiming benefits under an income tax treaty or VAT certification. Applicants should confirm who needs Form 6166 and what Form 8802 documents are required before submission.

Who can sign Form 8802?

Form 8802 must be signed by a person authorized to sign for the applicant. The correct signatory depends on whether the applicant is an individual, corporation, partnership, trust, estate, disregarded entity, or other entity type.

Does Form8802.com file the forms with the IRS?

Form8802.com does not transmit an application to the IRS without the user’s direction. Users are responsible for reviewing, approving, signing, and submitting the completed application package.

Submission may be completed by mailing the package, faxing the package when permitted, or using Form8802.com’s optional user-directed Form 8802 e-fax submission portal.

Do I have to pay fees to file IRS Form 8802?

Yes. The IRS charges a user fee to process Form 8802. The Form 8802 user fee is separate from the Form8802.com preparation fee.

As of the current IRS instructions, the user fee is $85 per Form 8802 for individual applicants and $185 per Form 8802 for non-individual applicants. These IRS user fees apply regardless of the number of countries or tax years requested on the application.

How do I submit a Form 8802 application?

In order to submit, applicants must first complete Form 8802, pay the IRS user fee, enter the Pay.gov confirmation number if paying electronically, include required supporting documents, sign the form, and use the correct IRS submission method. Can Form 8802 be submitted online?

Can one Form 8802 request multiple Forms 6166?

What should I do after I receive Form 6166?

How do I find out my treaty benefit, reduced rate, exemption, or refund amount?

Form 6166 certifies U.S. tax residency. It does not determine the treaty article, withholding rate, exemption amount, refund amount, or whether a foreign payer must apply a reduced rate.

What if my request for Form 6166 is denied?
