Form 8802 may be faxed to the IRS when the required user fee has been paid electronically. The current IRS fax numbers are 877-824-9110 for transmissions within the United States and 304-707-9792 for transmissions from inside or outside the United States.

Faxing does not create an expedited processing path. The IRS still reviews the application under its normal Form 8802 procedures before issuing Form 6166.

For mailing and private-delivery information, review the Form 8802 mailing address.

What Is the Form 8802 Fax Number?

The IRS currently provides two fax numbers for Form 8802:

  • 877-824-9110: for transmissions within the United States only; toll-free
  • 304-707-9792: for transmissions from inside or outside the United States; not toll-free

Applicants should verify the current fax numbers in the IRS Form 8802 filing guidance before transmitting an application.

When Can Form 8802 Be Faxed?

Form 8802 may be faxed when the user fee has been paid electronically. The electronic payment confirmation number must be entered on page 1 of Form 8802.

The IRS permits up to 10 Forms 8802, including all required attachments, in one fax transmission. The entire transmission may not exceed 100 pages.

A fax cover sheet stating the total number of pages included in the transmission is required.

What Should Be Included When Faxing Form 8802?

The fax should include the complete Form 8802 application, the required attachments, and a cover sheet stating the total number of transmitted pages.

Common items include:

  • The completed and signed Form 8802
  • The electronic payment confirmation number entered on page 1
  • Any required supporting documents or statements
  • Any tax return copy required for the application
  • A fax cover sheet showing the total page count

Applicants should confirm all documents required for Form 8802 before sending the fax.

Why Electronic Payment Is Required for Fax Submission

The IRS fax option is available only when the Form 8802 user fee has been paid electronically. The electronic payment confirmation number must be entered on page 1 of the application before it is faxed.

Pay.gov now requires applicants to upload a copy of Form 8802 when making the payment. That upload does not submit the application to the IRS for processing. The complete Form 8802 and attachments must still be sent separately by fax or mail.

Electronic payment requirements are covered in more detail in Form 8802 electronic payment.

Common Fax Submission Problems

Fax submission can create problems if pages are missing, unreadable, or sent to the wrong number. These issues can slow down IRS review even when the application itself is otherwise accurate.

Common fax-related problems include:

  • Illegible pages
  • Missing signatures
  • Missing supporting attachments
  • Missing payment confirmation details
  • Sending the fax to the wrong IRS fax number
  • Exceeding the 100-page transmission limit
  • Omitting the required fax cover sheet or page count

These issues can contribute to Form 8802 delays and rejections.

Does Faxing Form 8802 Make Processing Faster?

Faxing may reduce mailing time, but it does not guarantee faster IRS processing. Once received, the application is still reviewed according to IRS procedures and workload.

Applicants with urgent deadlines should review whether Form 8802 processing can be expedited and plan around normal IRS review timelines.

What Happens After Faxing Form 8802?

After Form 8802 is faxed, applicants should keep their fax confirmation records and payment confirmation details. These records may help if follow-up is needed.

The IRS review process after submission is explained in what happens after submitting Form 8802.

Applicants can use the Form 8802 status check to compare the fax date with the current IRS processing queue. If the queue has moved beyond that period and no update has arrived, review the Form 8802 phone number before calling.
